Claims against your insurance broker

Was your home and contents policy arranged through a broker?

Only a handful of insurance companies covered all types of damage caused by all types of innundation.

Insurance brokers have a duty to investigate a clients requirements and the nature of the risk that they offer to obtain insurance cover for.

For people living beside or close to the Brisbane River or in flood prone areas, brokers ought to have considered policies that provided flood cover and offered it to their clients.

If this didn't occur and you would have been prepared to pay the higher premium or suffer any other disadvantages contained in a comprehensive flood policy eg deductibles for day-to-day cover, you have a potential claim against the broker for the value of the uninsured loss.

Professional body corporate administration organisations who make annual recommendations as to an appropriate insurer for a unit, apartment or townhouse complex, also have a duty to investigate the various availabile policies having regard to the nature of the risk.

For buildings beside or close to the Brisbane River or in flood prone areas, body corporate managers ought to have considered policies that provided flood cover and made recommendations one way or the other to the committee.

If this didn't occur, you have a potential claim against the manager for the value of the uninsured loss.

Insurers are required to provide Product Disclosure Statements (PDSs) to consumers before the policy is entered into. If you did not have a broker and did not receive a PDS that prominently notified the exclusion for flood, then you have a potential claim for the value of your uninsured loss.
