Compensation - Commercial & Consumer
Claims against deceased estates by potential beneficiaries left out of a relative's will
Queensland law allows family or dependants who suffer hardship because they have been overlooked or inadequately provided for in a will to bring a lawsuit for compensation.
Written notice must be given within six (6) months and legal action commenced within 9 months of the date of death. To get started, collect relevant information as best you can including a list of estate assets, a list of surviving dependants and particulars of your relationship with the deceased.
Insurance Disputes
Insurers routinely deny or attempt underpayment of claims even where the policy clearly covers the loss. That's their business and ours is to make them accountable.
If you have a large claim that has been denied which ought to have been paid, we will negotiate with your insurer and where necessary, hold them responsible with a lawsuit.
Our expertise includes disability or life policies, superannuation policies and car, home & theft, business interruption claims, professional indemnity insurance and property damage.
Shareholder & investor claims against corporations and directors
Companies and their directors have duties to fully disclose all share-price sensitive and company-value information to shareholders.
They are prohibited from doing anything to manipulate share values.
Recent Australian corporate history has shown that many corporations ignore these rules.
If you have suffered an investment or stock market loss in these circumstances, call us for advice.
Compensation for resumptions
Landowners should contact Carter Capner Law if they receive a Notice of Intention to Resume.
The Council must reimburse all reasonable legal and valuation fees incurred in the preparation and lodgement of your claim.
Compensation may be claimed for:
- Severance - the value of the land resumed; and
- Disturbance - the 'damage' caused to any remaining land.
Consumer disputes
The Trade Practices Act and Fair Trading Act provide protection in many consumer transactions: retail, housing construction, and travel to mention a few.
Consumer credit laws also impose strict duties on lenders and others relating to loan contracts and repossessions.
If you have a substantial dispute it will pay to invest in a sound legal strategy and an expert law team. Early advice is the key to a successful outcome.
